As a consumer reporting agency governed by the federal Fair Credit Reporting Act (FCRA) among other applicable state and federal laws, Valley Track, LLC. is committed to protecting your privacy.

This Privacy Policy covers the information practices of Valley Track and sets forth our privacy provisions relating to information submitted by our clients and their applicants and employees (as well as other individuals who have given their written authorization for Valley Track’s clients to conduct a background investigation on them), using Valley Track’s online background screening solution that is accessible only through an access-restricted portion of Valley Track’s website. This Policy also applies to other data that we collect from third parties and other sources in connection with our screening services. All data shall be collected, stored and used in compliance with applicable law, including the FCRA.E

The Information We Collect and How We Use It:

We provide applicant screening services only to businesses with a permissible purpose in accordance with the FCRA. Our services include performing background checks on applicants for employment, contractors and others pursuant to the FCRA. We release information via telephone, fax, mail and electronically, only to the individual(s) or business(s) that originally requested the service. We do not sell or provide personal information collected or maintained in our system to an outside entity for any purposes. Similarly, we do not compile mailing lists consisting of subjects of our screening reports for any purpose not related to a permissible purpose.

Valley Track clients provide personal information regarding their employees or prospective employees via our website (www.valleytrack.com) when placing an order for background screening services. Information provided may include but is not limited to residential history, personal history including name, date of birth, Social Security Number, Motor Vehicle Operator’s License Number, Professional License information, employment history, education and other credentials. Valley Track will use information provided by the client and subject of the order, along with any other information provided by third-parties, only for the execution of producing a background screening report for the client placing the order, and for no other purpose. Valley Track will not process personal information in a way that is incompatible with the purpose for which it has been collected or subsequently authorized by the individual. We reserve the right to employ other organizations or individuals as our subcontractors, to perform functions on behalf of Valley Track. These organizations and individuals will not share information with any third party, other than Valley Track subcontractors or clients.

Personal Information Disclosure: U.S. or Overseas:

We do not store or process data oversees. Your personal information may only be transferred to third parties outside the United States or its territories only to the extent that it is necessary to conduct a background check on you from sources of information outside of the United States. This transfer of information will only occur if you have resided or have been employed outside of the United States and we are requested by your employer or proposed employer to conduct a background check from sources outside of the United States. Valley Track complies with the General Data Protection Regulation (GDPR) standards as set by the European Union (EU).

Security/Data Integrity:

Valley Track data is transferred using Secure Socket layer (SSL) technology and is User ID and Password protected. The servers that are used to store sensitive personal information are kept in a facility that is monitored and staffed twenty four hours a day, seven days a week by on-site security personnel and only authorized personnel have access.

Retention:

Pursuant to the FCRA, Valley Track must maintain any reports which we generate for a minimum period of five years. After the retention period information is subsequently destroyed either electronically or mechanically.

Your ability to Review or Modify Personal information:

If you are a Valley Track client you may review and update your account information by logging into your account. If you are an individual whom a Valley Track client has requested a background screening investigation, and have submitted personal information to Valley Track at the request of such client for purposes of procuring a background report, then you can review your Valley Track file in accordance with the file disclosure rights under the FCRA, and California Civil Code Section 1786.22 and any other applicable laws by contacting Valley Track at info@valleytrack.com. You can review a summary of your consumer rights (including file disclosure rights) under the Fair Credit Reporting Act by accessing: https://www.consumer.ftc.gov/articles/pdf-0096-fair-credit-reporting-act.pdf.

Children’s Privacy:

Valley Track does not offer services to children under the age of 13, and our website is not directed to children under the age of 13.Valley Track does not knowingly collect information about children under the age of 13.

Access:

We provide access to you on all data collected about you in order to give you the reasonable opportunity to confirm what personal data that we possesses about you, and to correct, amend or delete information that is inaccurate or incomplete. Disclosure is provided under the terms of the federal Fair Credit Reporting Act. Under all circumstances, you are entitled to a copy of your report under the terms of the FCRA. Valley Track reserves the right to engage in reasonable efforts to confirm the identity of anyone requesting data, so that we only provide data to the consumer that is the subject of the data. For your protection, we will require proof of identity, including proper verification and confirmation that you are the individual who is entitled to request access, before providing information to you. If we collected information from you, we will mail you, if you are a U.S. resident, a copy of the report about you, as it has been provided to your current or prospective employer, at no charge.

Accuracy of Information:

Although we make every effort to ensure that the data we collect and store about you is as accurate as possible, we rely on other entities, including but not limited to courts, educational institutions, individuals and other sources for the information, and therefore cannot guarantee the accuracy of the information reported. If you believe any information that is in Valley Track’s possession is incorrect, please contact Valley Track directly to discuss this with a support representative. This Privacy Policy may be modified or amended at any time without prior notice. Please review this Privacy Policy prior to contacting us with requests or questions.
